Can see this website is still in it's infancy stages but already has some very interesting/useful posts ! Here is my contribution...
 
Special Commissioners ruling in 2002 that M&S could not off-set European subsiduary losses against it's UK parent company profits could get overturned later this year... watch this space.
 
The case is going to the European Court and it is expected that the taxpayer might well win.
 
Initial advice from the advocate-general recommends that M&S can use £100m of tax losses made in continental Europe to offset against past UK profits.
 
It could be a very sensible idea to make protective loss claims where appropriate within the normal time limits if this affects any group of companies you act for !

IR Lost ! Good to see HMRC get a beating as they do enough of this of ordinary tax payers without even batting an eyelid...
 
Well done the Eurpoean Court recently. The likely benefit to tax payers generally is likely to be extremely limited but never the less well done M&S.
 
It seems M&S at least are determined to see HMRC act properly, fairly and within reasonable law!
