PAYE end of year online filing service temporarily unavailable HM Revenue and Customs has said that it will be withdrawing temporarily the part of the PAYE Online for Employers - Internet service that allows employers and agents to file Employer’s Annual Returns (P35 and P14s). The service will be unavailable from 1 March to 5 April. In its statement, HMRC said: “This is so we can upgrade it to include the quality checks your Return will have to pass for 2005-06. Only the facility to file end of year Returns is affected so, for example, registration and enrolment, preferences and the sending and receiving of all other forms and Returns are not affected. The full service will be restored by 6 April 2006. Electronic Data Interchange users are not affected at all. This means that between 1 March and 5 April inclusive you will not be able to file your 2005-06 Return (due from 6 April) online using either Third Party Software or our Online Return and Forms – PAYE product. Nor will you be able to send 2004-05 Returns or a ‘test in live’ Return. Our Online Return and Forms – PAYE product will be available for you to input and prepare P35 and P14 data, but you will not be able to send that information until the service is switched back on.” The statement continued: “If you try to file an end of year Return before we have turned the service back on it will fail and you will get error message 1046 saying ‘Authentication failure. The supplied user credentials failed validation for the requested service.’ This does not mean you have entered the wrong user id or password during the suspension period. It simply indicates that the service is not available for submission. We are acutely aware that a number of employers and agents would have liked to submit their 2005-06 Return before 6 April 2006 and we will do all that we can to restore full service as soon as possible after testing and a successful upgrade.” |

Thought this might be an interesting bit of info to get this board started! Defininition of "enterprise" in the Double Tax Treaties? There is no definition of "enterprise".... "There is no definition of `enterprise' but it is clear from the context in which the term appears that it must be some sort of business or commercial undertaking. Some of our treaties, mainly older ones but including that with the United States, use instead the term `industrial or commercial undertaking'" http://www.hmrc.gov.uk/manuals/ithmanual/html/ITH0500/06_0016_ITH524.htm Other useful bits for forum members on these type of issues would be helpful .. |

Just notices we are all talking about Artic. If anyone is doing their own research the case name is Jones v Garnett! Just an obvious point missed in the comments so far! This case deals with 3 important issues: a) the validity of UK law dealing with transfers of going concerns, b) the nature of 'goodwill' from a VAT perspective c) and eligibility for Eighth Directive refunds.
